Insurance co is saying my car is totalled?

I have an 11-yr old car with 106K miles that runs well. Last night I was rear-ended quite hard while waiting at a red light. Both the other driver and his insurance co immediately admitted liability. The damage to my car is pretty bad. I went to the auto body shop recommended by the other guy's insurance co - they told me the car will have to be totalled b/c it will cost more to repair than what the car is worth - he estimated the car is worth $2K and repairs will be at least $4K. So the insurance co is saying they'll give me a check for $2K and I have to get rid of the car (apparently that part is New York law). But I cannot buy another car - at least not one I'd trust to drive! - for $2K. The accident was completely NOT my fault - how can the insurance co not pay to repair it? Should I hire an attorney for this?, I purchased a policy online a few months ago within the first few days that i had this insurance I had a storm and damaged my vehicle (minor) with hail damaged I submitted out a claim, appraiser was sent they covered the loss sent a check to me, now i take it to the bodyshop and try to have it fixed but they need a supplement, they contact insurance co. but insurance co, makes many excuses over this they state I dont have full coverage which I do, and it was verfied with them that i do, the next few weeks pass and then I finally get a call from a manager at the insurance company stating that they mistakenly sent me out a check because I made a false claim report, they said that they can tell by my pictures before policy was bought that vehicle had damaged (which is an excuse of denying supplement) and stated the the adjuster overlooked everything point here is that insurance co, cancelled my policy by stating underwriting issues, so now Im without insurance coverage, the manager also stated she reported this to the texas state but mentioned she could not put a stop payment on the check and that I could still use it to fix the car or cashout the check... I am really dissapointed at how all this was handelled, Im thinking about getting an attorney, I already discussed and this issue with the Insurance company and Im basicly told that I lied about the claim and they end my call... Should I wait to get an attorney or should I just get one and go from there? I believe this is bad faith insurance coverage, What should I do? I mean I still have the check it is not cashed out, I cant really do much with this check everyone charges an arm and a leg, can they file insurance fraud charges and if so even though I know I did everything right should I get an attorney?

Auto Insurance company is refusing to cover my rental car. What can I do to fight this?

Exactly a week ago I was involved in an accident at the fault of another driver. The other driver's insurance company (USAA) has been sitting on the case not doing a damn thing. I had to call them yesterday just to get them to read my accident report, and accept liability. They hadn't even contacted the policy holder! They told me that they would set me up with a rental car, and cover the fees. Today I went to Enterprise to pick up the rental car and was asked if the insurance company (USAA) had mentioned anything about a underage bracket fee. When I told them that they hadn't, the woman at enterprise contacted USAA. It was then that they stated that they would not pay for the underage fee (I am 19), which is about $22 per day. Naturally, I was completely outraged. Both my insurance company and USAA's offices are closed at this time, so I have to wait until tomorrow to contact them. I was told by my agent that because the accident wasn't my fault, ANY cost that is a result of the accident MUST be covered by the other driver's insurance company. What can I do about this? I don't have the money to pay for the fee, but I need the transportation. I've already been without transportation for a week.

My friend is 16 and she saved up and bought a car (the title is in her name). Now she is broke and cannot afford the insurance so she does not drive it. Her step mom drives it though and she says that the car does not need insurance because she (the step mom) has driver insurance and any car she drives has liability coverage from her insurance. I have never heard of driver insurance and I was wondering if the step mom is pulling some sort of scam (her car is frequently broken and it is very convenient to have a third car) Can somebody tell me if this driver insurance exists.
